GENERAL TERMS

TERMS & CONDITIONS

The following terms and conditions apply between the clients and Laura Pozzi Studio (VAT ID n° IT03365500960), unless otherwise agreed in writing.

Quotes: Submitted quotes are valid for 14 days from the date of submission.
Prices: All stated prices are exclusive of the Italian VAT rate in force at any given time.

 

1. Terms of Payment and Late Fees

  • Standard Terms: All invoices are due within 14 days from the invoice date, unless otherwise specified in writing.

  • Extended Payment Deadlines: Any request for extended payment terms must be approved in writing by Laura Pozzi Studio. We reserve the right to apply the following surcharges to the total invoice amount for extended deadlines:

    • 30 days net: +0.5%

    • Current month + 30 days: +1.0%

    • 60 days net: +1.5%

    • 90 days net: +3.0%

  • Late Payments: In the event of late payment, statutory late interest will automatically accrue on the unpaid balance in accordance with Italian Legislative Decree n. 231/2002 (implementing EU Directive 2011/7/EU, currently equivalent to 10.15% per annum). Additionally, the client will be charged for any recovery costs and legal fees incurred, as permitted by European law. [1, 2, 3]

 

2. Booking and Cancellation Policy

  • Binding Bookings: Confirmed bookings of the studio, locations, photoshoots, etc., are binding unless cancelled in writing no later than 21 days before the scheduled date.

  • Cancellation Fees: If a booking is cancelled less than 21 days before the scheduled date, Laura Pozzi Studio will charge a fee based on the following rates (excluding retouching, image processing, and post-production):

    • Less than 21 days notice: 10% of the quoted amount

    • Less than 14 days notice: 20% of the quoted amount

    • Less than 7 days notice: 50% of the quoted amount

 

3. Copyright, Usage Rights and Credits

  • Ownership: Laura Pozzi Studio and any additional photographers, AI artists, or filmmakers in the team always retain full copyright and intellectual property rights for all produced material (pictures, videos, and creative concepts).

  • Selection Gallery: Images and films/videos displayed in the customer gallery during selection may not be copied, edited, modified, or otherwise used without written consent.

  • Modifications: Images and films/videos may not be copied, edited, modified, or otherwise altered by anyone other than Laura Pozzi Studio unless agreed in writing.

  • Usage License: Upon full payment of the invoice, the client is granted a non-exclusive, non-transferable license to use the final delivered material only for the purposes and channels specified in the quote.

  • Restrictions & Resale: Any third-party usage, sub-licensing, or resale of the material is strictly prohibited without prior written agreement. Material will not be shared with third parties without the client's prior consent.

  • Promotional Right: Laura Pozzi Studio reserves the right, taking into account the customer’s publication/release date, to use all images and films/videos for marketing purposes on its website, Instagram, LinkedIn, Facebook, other social networks, print media, trade fairs, exhibitions, and its own premises.

  • Credits: Laura Pozzi Studio requests credit for its work, although it is not mandatory. If you choose to credit the studio, please use the following format: [Type of project] + @laurapozzistudio.

  • Deliverables: Unless otherwise agreed, pictures and videos will be delivered fully processed via a web file transfer service in TIFF 8-bit Adobe RGB (1998) format. Working files and/or RAW files are strictly not provided.

 

4. GDPR and Data Protection

  • Required Information: In order to process and invoice assignments, Laura Pozzi Studio requires the following information: Company name, VAT number, Recipient Code (Codice Destinatario), contact person, contact address, contact telephone number, contact e-mail address, and, if applicable, the billing email address.

  • Purpose of Processing: Laura Pozzi Studio only registers this data for the purpose of delivering the agreed product/service to the customer and for legal accounting purposes. This personal data is registered within the accounting system used at the time and is treated in full compliance with the GDPR. For more details, please refer to our Cookies & Privacy Policy.

 

5. Insurance and Liability

  • Client Responsibility: It is the client's responsibility to insure their own employees, any people associated with the project/assignment who are paid/compensated directly by the customer, as well as products, scenery, props, etc., used in the project/assignment. This applies regardless of whether the work is carried out at the Laura Pozzi Studio space, external studios, or on location, both in Italy and abroad.

  • Location Damages: For projects/assignments on locations paid for by the customer, it is the customer’s responsibility to insure or bear all costs for any damages.

  • Studio Insurance: Laura Pozzi Studio insures its own employees and people associated with the project/assignment who are paid/compensated directly by Laura Pozzi Studio through a professional indemnity insurance policy (Italian RC insurance policy) strictly connected to the project/assignment.

 

6. Returns, Withdrawal and Complaints

  • Right of Withdrawal: There is no right of withdrawal or return for services purchased from Laura Pozzi Studio, as these consist of customized and bespoke professional services.

  • Right of Complaint: Any complaints must be submitted to Laura Pozzi Studio by email no later than 10 working days after the delivery of the fully processed images and films/videos.

 

7. Data Storage, Force Majeure and Jurisdiction

  • Data Storage: Data is stored for a minimum of 12 months from the completion of the project/assignment. After this period, Laura Pozzi Studio reserves the right to delete the files.

  • Force Majeure: Laura Pozzi Studio cannot be held liable for the loss of data, or for damage to any goods caused by force majeure events beyond its reasonable control.

  • Governing Law and Jurisdiction: These Terms & Conditions are governed by and construed in accordance with the laws of Italy. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the Court of Milan, Italy.
